Immigration for workers - Employment-Based Immigration to Canada
The
Canadian economy is constantly in need of new workers. Local
candidates do not fill all vacancies in the Canadian labour market.
That is why Immigration, Refugees, and Citizenship Canada (IRCC)
constantly issues work permits for foreigners who have found work in
Canada. In addition, Canada is actively looking for people who
already have experience in Canada, so immigration for workers is a
great way to get permanent residence in Canada.
There are several ways a foreigner can get a work permit in Canada.
Immigration through work in Canada is possible in two main ways -
with the support of the employer and obtaining work permits based on
the Labor Market Impact Assessment (LMIA) as part of the Temporary
Foreign Workers Program.
The main goal of this immigration pathway is to gain enough Canadian
work experience to qualify for immigration through the Federal
Skilled Worker Program, the Federal Skilled Trades Program, and the
Canadian Experience Class, which are served by Express Entry or
through or some streams of the Provincial Nominee Program.
Immigration for workers with the support of employers
through the Labour Market Impact Assessment (LMIA):
Stage 1:
Search for an employer
Immigration through work is only possible with the support of
Canadian employers. Many Canadian employers cooperate with our
company and inform us of vacancies that they cannot fill. In such
cases, we publish job advertisements on our social media. You can
also find your employer yourself through various job sites or social
media.
Stage 2: Obtaining a positive LMIA
To get a positive Labour Market Impact Assessment (LMIA), your
employer will need to prepare all financial documents and comply
with all the requirements of the authorities. We submit the LMIA
application to Employment and Social Development Canada, proving
that the employer did not find a specialist in Canada. We help your
employer prove that your hiring will have a positive effect on the
Canadian economy.
Stage 3: Applying for a Work Permit and
other documents
To work in Canada you will need proper documents from the Canadian
government. During this stage, you also receive the instructions
regarding the documents we will need to apply for a Work Permit and
if you are not from the visa-exempt country, you will also need a
Temporary Resident Visa (if required). If your spouse and/or
children are coming with you, we will also need to apply for a Work
Permit for your spouse and a Study Permit for your children. If your
occupation is a regulated trade, you may also need to obtain a
respective provincial licence and certification to practice your
trade in Canada.
Stage 4: Work Permit and Work in Canada
Once your application for the Work Permit and other documents has
been approved, you can come to Canada. Your Work Permit will be
issued by the border officer when you land in Canada. Now your task
is to gain Canadian Work Experience. You will become eligible for
several immigration programs as soon as you gain at least one year
of work in Canada.
Stage 5: Choosing an immigration path
Once you become eligible for any immigration program we will prepare
and submit your Permanent Resident application. Depending on your
situation we will advise the proper immigration path. Immigration
for workers at this point is possible via Express Entry's Canadian
Experience Class or relevant provincial streams. In the case of the
provincial immigration strategy, we will first apply for a
provincial nomination and then apply for permanent residence
Stage 6: Application processing
This stage is the longest in the whole process. The Federal
government will check your application for completeness and make
sure that you satisfy all the requirements of your immigration
program. During this stage, you will have to pass the medical exam
and background check. The background check consists of criminality
and security assessments. In some cases, the IRCC may request
additional documents to make a final decision.
Stage 7: Becoming a Permanent Resident
Once all checks are cleared, you will receive a Ready for Visa email
with the request to send your passports or passport copies to the
Visa office. 3-4 weeks after that you will get a Confirmation of the
Permanent Residency. With this document, you will be able to come to
Canada and do the landing. After the landing, you will be officially
a Permanent Resident of Canada.
